How Do I Set Aside My Record?

Expungements or Motion to Set Aside Record

NOTE: THIS INFORMATION IS GIVEN AS AN AID TO ASSIST PEOPLE WHO DESIRE TO LEARN ABOUT SETTING ASIDE THEIR RECORDS, IT IS NOT MEANT TO DELIVER LEGAL ADVICE OR A LEGAL OPINION. IN NO WAY IS THIS INFORMATION MEANT TO REPLACE THE ADVICE OF LEGAL COUNSEL.

Oregon Revised Statute 137.225 sets forth the authority for setting aside records of arrests and/or convictions in the State of Oregon. Any person interested in pursuing this process should read the statute carefully and talk to an attorney if necessary. There are fees for filing that can be found at the Oregon Judicial Department website. Another good resource is the Oregon State Police/Expungment Section web site.

The District Attorney’s office is not able to assist persons in the preparation of documents or give advice regarding whether or not a record is appropriate for set aside.
