VACATION PROCEDURES
Forms for petition must be obtained
& returned to the Public Works Department for processing.
1.
PETITION - Must have
A. Description of property to be vacated.
B. Statement of reason for the requesting
vacation.
C. Names and addresses of ALL
persons owning any improvements on public property to be vacated.
& / OR
D. Names &
addresses of ALL persons holding any recorded interest in property
proposed to be vacated.
& / OR
E. Names & addresses
of ALL persons owning any Real Property abutting public property
proposed to be vacated.
F. Signatures of
owners of 60% of land abutting property proposed to be vacated.
G. Signatures shall be notarized.
&
$ 20.00 for the Clerk’s office for recording.

REPORT - Ordered from the
A. Description of
ownership & uses of property proposed to be vacated.
B. Assessment by
Director of Public Works of whether vacation would be in the public interest.
C. Any other
pertinent information.
3. UPON -
Receipt of report, Board of Commissioners establishes a time and a place for hearing
to consider whether proposed vacation is in public interest.
4. NOTICE OF HEARING-
By posting ( 4 places , including proposed property to be vacated , 30 days
prior ) , publication ( 20 days prior and 10 days prior ), and by service to
each person with recorded interest ( 30 days prior by registered letter).
A. Property proposed to be vacated.
B. An improvement constructed on public
property proposed to be vacated.
C. Real Property abutting public property
proposed to be vacated.

OWNERSHIP OF VACATED PROPERTY
A. If County
holds title; property shall vest in the County.
B. Otherwise,
vacated property shall vest in the owner of the land abutting vacated property
by extension of the person’s abutting property boundaries to the center of the
vacated property.
