Dear Party of Record:


            This notice is to advise you of an extended open record schedule to allow additional public comment (legal argument and new evidence) for a longer period of time than previously stated and to allow the Planning Commission members more time to review the arguments and evidence in the Record. At the conclusion of the January 30, 2024 public hearing, the Planning Commission left the record open for one week (until February 6) for anyone to submit any argument or evidence on any topic relevant to the above-mentioned Dollar General appeals; then for one week (until February 13) for anyone to respond to argument or evidence submitted during the first open-record segment; then for one final week (until February 20) for the applicant’s final rebuttal (no new evidence). The Planning Commission then continued the hearing for deliberation and decision only (no additional testimony) to its February 27, 2024 regular meeting


            In light of the large public interest in these matters and the volume and diversity of issues raised in public comment and at the January 30 public hearing, the Planning Commission Chair has ordered that the first open-record segment shall be extended to allow greater public in-put and to allow the Planning Commission an adequate amount of time to review the Record. Accordingly, the following new Open-Record Schedule shall apply to these appeals:


New Open-Record Schedule:


  • First segment – February 20, 2024 – any relevant comment, argument or evidence from anyone;
  • Second segment – February 27, 2024 – any response (including argument and evidence) to anything submitted during the first segment;
  • Third segment – March 5, 2024 – Applicant’s final rebuttal under ORS 197.797(6)(e), no new evidence.


            Submissions may be sent by any method, including hand-delivery, but must be received by the Wallowa County Planning Department (101 S River Street Room 105, Enterprise, OR) no later than 5:00 p.m. on the above-listed dates. If sent via e-mail, please send submissions to: plantech [at] (). E-mail submissions must be received by 5:00 p.m. on the date due.


Hearing Continuance: The Wallowa County Planning Commission will continue these matters to its regular meeting on March 26, 2024 at 7:00 p.m. at the Wallowa County Courthouse for deliberation and a possible tentative decision on the appeals. No public testimony will be allowed at the March 26, 2024 continued hearing.
